Clever Programmer Terms of Service

If you are enrolled in one of our Bootcamps, please refer to your Bootcamp Agreement for additional Terms and Conditions. 

1. Terms

By accessing the website at https://www.cleverprogrammer.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Clever Programmer's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Clever Programmer's website;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Clever Programmer at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

  1. The materials on Clever Programmer's website are provided on an 'as is' basis. Clever Programmer makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, Clever Programmer does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. MONEY BACK GUARANTEE REQUIREMENTS 

Specific for Profit with JavaScript and Profit with Python only.

  1. You must implement all the strategies taught in the course or program. You must watch all the training videos, review all resources, and complete every corresponding action item in the course or program. The course's content is subject to change, but you are required to complete all material of the course that was available to you at your time of purchase. You must show documented proof that you have completed the course and tracked your results or progress as indicated in the course. Each course or training program consists of videos, slideshows, and other training materials and you must complete all modules AND take action steps on actionable activities as outlined in the course in order to claim a refund. You must show documented proof that you have made attempts to implement all of the strategies taught in the program or course before requesting a refund.
  2. You must leverage our world-class support team for assistance. We care about our students, clients, and customers. If there are any questions or concerns regarding your purchase or anything that arises that is preventing you from achieving results, you must email [email protected] for assistance.
    You must show documented proof that you have tried emailing with your questions and concerns AT LEAST once before requesting a refund and we will check our records to see how the situation was handled.
  3. You must document all of the proof you perform in a Google Doc or other shareable document, including when you performed the action. It is imperative that you document this data in the Google Doc immediately after you perform each requirement listed above, because Google will track when you made updates to the document, and this is how we will know that you met the requirements in the time allotted. We want you to have success with all of our programs and courses, therefore you must start implementing what we've taught you within 7 days of your purchase. You must document your activities and if within the refund period, decide you wish to stop using the program and get a refund, provide us with all of this documentation before requesting a refund.
  4. Please note that the 30 day Money Back Guarantee is only for the pay in full option. If you select the payment plan, the first payment is not refundable, however if you are not satisfied with the course we can cancel the remainder of your payment plan due and revoke your course access.

You must contact us between within 7 days of the expiration date of your guarantee notifying us you will be submitting a refund request and have your documentation ready for review. No exceptions.

5. Limitations

In no event shall Clever Programmer or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Clever Programmer's website, even if Clever Programmer or a Clever Programmer authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on Clever Programmer website could include technical, typographical, or photographic errors. Clever Programmer does not warrant that any of the materials on its website are accurate, complete or current. Clever Programmer may make changes to the materials contained on its website at any time without notice. However Clever Programmer does not make any commitment to update the materials.

Clever Programmer has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Clever Programmer of the site. Use of any such linked website is at the user's own risk.

8. Modifications

Clever Programmer may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of USA and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Being a part of our exclusive Slack and Facebook communities are a privilege. We reserve the right to remove students from these communities. Any negative, inappropriate behavior, harassment, misconduct, or spamming will be removed from the communities and the member may be banned from rejoining. Inviting non-members to the slack community will also result in a student's removal from the community.

We expect all staff, teachers, employees, mentors, students and basically everyone involved with the school, to help us create a safe and positive environment for everyone.   • Refrain from demeaning, discriminatory, or harassing behavior and speech.
  • Create a positive impact on everything around them.
  • Participate in an authentic and active way.

But if you need a more explicit list: Unacceptable behaviors include harassing, abusive, disparaging statements about Clever Programmer, discriminatory, or derogatory conduct. Harassment includes: offensive comments related to gender, sexual orientation, race, religion, disability; inappropriate use of sexual images; deliberate intimidation, stalking, or following; harassing photography or recording; sustained disruption of talks or events; inappropriate physical contact, and unwelcome sexual attention.

Please be aware that our platform is for learning about coding and all coding related questions. Therefore, any communications that do not comport with that or that violate the above policy will be removed. Furthermore, it could result in complete removal of the violator’s slack access. This will be everyone's one and only warning. We appreciate your continued cooperation.

Your purchase of a product or service or ticket to an event may or may not provide any refund. Each specific product, service, event or course will specify its own refund policy.
